These terms apply to our Guaranteed Gift feature and supplement the Customer Terms of Service.

  1. Guaranteed Gift Feature.
    1. The “Guaranteed Gift” is a feature that automatically converts any Gift not Claimed by a Recipient within the designated timeframe into a Gift Credit on the Snappy Platform (such timeframe, the “Claim Period”). A “ Gift Credit” refers to a digital credit to redeem a Gift for (a) Snappy’s Dining Card (an open-loop Visa® prepaid card issued by a third-party Gift Vendor issuer) or (b) another digital credit or item that Snappy may make available from time to time in its sole discretion ( a “Digital Gift”).
    2. The Guaranteed Gift feature may be enabled by default in the Customer’s dashboard. Customer is responsible for (i) reviewing the Guaranteed Gift settings in their Dashboard; (ii) enabling or disabling the feature prior to sending a Gift to a Recipient and (iii) if enabled, selecting the desired Claim Period.
    3. The Guaranteed Gift feature can only be set prior to sending a Gift to a Recipient. If Customer wishes to adjust the Guaranteed Gift settings with respect to a Gift or Gift campaign that has already been sent (and not yet Claimed), Customer must cancel the original Gift and resend it with the new settings.
  2. Invoicing; Gift Credit Notification; Value.
    1. Upon expiration of the Claim Period, Snappy will charge the Customer the Total Gift Fees and the Recipient will be notified that they have been issued a Gift Credit, together with instructions on how to redeem it.
    2. For the purposes of the Guaranteed Gift feature, the value of the Gift Fee, Gift Credit, and the resulting Gift Vendor Instrument to be issued to the Recipient upon redemption of a Gift Credit, is equal to the amount of the maximum estimated Gift Fee selected by Customer for the Gift.
  3. Gift Credits Terms and Disclaimers.
    1. Gift Credits are redeemable solely through the Snappy Platform and (i) not cash or redeemable for cash, (ii) are not refundable to the Customer or Recipient, (iii) have no face value, (iv) are not denominated in currency, (v) are non-transferrable, (vi) do not expire. No additional funds can be added to or associated with a Gift Credit.
    2. Gift Credits are issued by and solely the obligation of Snappy; however, Snappy may assign its obligations with respect to the Gift Credits at any time to a Snappy Affiliate, after which the Snappy Affiliate becomes the issuer and sole obligor to the Recipient with respect to the Gift Credits.
  4. Snappy’s Dining Card/Digital Gift Terms and Disclaimers.
    1. Snappy’s Dining Card (or other Digital Gift) may be subject to geographic, regulatory, and third-party card issuer limitations as set forth in the Gift Vendor terms and conditions provided to the Recipient when redeeming the Gift Credit.
    2. Snappy’s Dining Card (or other Digital Gift) is issued by and is solely the obligation of the Gift Vendor, and may only be redeemed and used in accordance with that Gift Vendor’s terms and conditions. Snappy and its Affiliates are not responsible for, and will have no liability with respect to any Snappy’s Dining Card (or other Digital Gift) or the acts or omission of any Gift Vendor.
